Terms and Conditions of Sale


1. Applicability & Legal Identity
These Terms and Conditions apply to all goods supplied by Safety Glass Replacements Limited (trading as Well Glass UK) (“we”, “us”, “our”) to the customer (“you”, “your”). By placing an order with us, you are agreeing to these Terms and Conditions.

2. Order Confirmation and Approval
2.1. All bespoke orders require your explicit written approval of the final manufacturing drawing before production begins.
2.2. Production will not commence without this approval. The estimated lead time typically begins from the date of this confirmation, not the date of initial payment.
2.3. You acknowledge responsibility for verifying all measurements and specifications prior to approval.

3. Bespoke Goods: Cancellation and Returns
3.1. Due to the bespoke and custom nature of the goods (manufactured to your specific dimensions and requirements), they are exempt from the cancellation rights usually afforded by the Consumer Contracts Regulations 2013.
3.2. No Returns or Cancellations: Orders cannot be cancelled, returned, or refunded once production has commenced or goods have been dispatched, unless the goods are proven to be faulty or not to the agreed specification.

4. Lead Times and Delivery Estimates
4.1. Estimates Only: Any lead times or delivery dates provided (e.g., “4-6 weeks”) are estimates only and are not guaranteed.
4.2. Delays: While we endeavor to meet these targets, delays can occur due to third-party finishing processes (galvanizing/powder coating), material shortages, or courier disruptions.
4.3. Not of the Essence: Time for delivery shall not be of the essence of the contract. We shall not be liable for any direct or indirect loss, costs, damages, charges, or expenses caused directly or indirectly by any delay in the delivery of the goods.

5. Scheduling Trades and Installation
5.1. Do Not Book Early: We strongly advise against booking builders, installers, or other tradespeople until the goods have been physically delivered to your site and inspected.
5.2. Your Risk: If you choose to book tradespeople before the goods have arrived and been checked, you do so at your own risk.
5.3. No Liability for Contractor Costs: We are not liable for any aborted visits, standing time, cancellation fees, or consequential costs charged by your contractors due to delivery delays, transit damage, or manufacturing errors that require rectification.

6. Scope of Supply & Recommendations
6.1. Our contract is strictly for the supply of goods only. We do not provide installation, fitting, or site preparation services unless explicitly agreed in writing.
6.2. Professional Installation: We strongly recommend that all installations be performed by qualified professionals familiar with bespoke installations.
6.3. It is your sole responsibility to ensure the site is properly prepared and suitable for the installation of the supplied goods.

7. Inspection and Acceptance
7.1. Upon delivery, you must inspect all goods immediately and verify they conform to the approved drawings and are free from damage.
7.2. Any defects, damage, or deviations must be reported to us in writing within 48 hours of receipt, accompanied by photographic evidence.
7.3. Installation Implies Acceptance: Installation, painting, or modification of any goods constitutes final acceptance of the goods as fit for purpose, correct in size, specification, and condition. We cannot accept claims for damage, colour, or sizing errors once the unit has been installed or altered in any way.

8. Liability for Damage & Finishing Errors
8.1. While damage in transit is rare, any damage affecting size, shape, or surface must be reported promptly (within 48 hours).
8.2. Our liability for transit damage is limited to the repair or replacement of the goods supplied.
8.3. In the case of minor cosmetic paint damage, we reserve the right to supply matching touch-up paint free of charge rather than replacing the unit.
8.4. Remedy for Finishing Errors: In the event of a finishing error (e.g., incorrect powder coating colour), our liability is strictly limited to:
a) Collecting and re-coating the item, OR
b) Providing a refund/credit equivalent to the trade cost of the finishing service.
We are not liable for third-party installation or removal costs incurred by the customer.

9. Handmade Tolerances & Material Characteristics
9.1. All of our products are handcrafted. As such, slight variations in shape, dimension, and finish may occur as part of the normal manufacturing process.
9.2. Minor imperfections (e.g., slight deviations from a perfect circle or subtle surface variations) are inherent in bespoke metalwork and are not considered defects.
9.3. Glass Colour & Tint: You acknowledge that standard float glass (especially in multi-laminate/walk-on thicknesses) possesses a natural green tint that increases with thickness. This will affect the visual appearance of coloured borders printed beneath the glass. We cannot guarantee a colour match between a surface-painted frame and a border viewed through thick glass. Marketing photos often feature Low Iron glass; unless Low Iron is specified in your order, the finish will differ from these images.

10. Limitation of Liability
10.1. We accept no liability for consequential or indirect losses, including but not limited to: loss of profit, loss of business, damage to surrounding works (flooring, joinery), or costs incurred from site modifications.
10.2. Any modifications or alterations made to the goods after delivery without our consent will void any warranty.

11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
